Welcome to Battle Fish: Battle Royale ("the Game"), developed and published by Vitryx Studios ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of Battle Fish: Battle Royale, our website (if applicable), and any related online services. By downloading, installing, accessing or playing the Game, you agree to be bound by these Terms. If you do not agree, you must not use the Game. 1. ELIGIBILITY You must comply with all applicable laws when using the Game. If you are under the age required to enter into a binding agreement in your country, a parent or legal guardian must review and accept these Terms on your behalf. 2. YOUR ACCOUNT Some features may require an account. You agree to: provide accurate information; keep your login credentials secure; notify us if you believe your account has been compromised; accept responsibility for activity occurring under your account. You must not: sell accounts; rent accounts; share accounts; purchase stolen accounts; impersonate another person. We reserve the right to suspend or terminate accounts that violate these Terms. 3. LICENCE TO USE THE GAME Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Game for personal entertainment purposes. This licence does not transfer ownership of the Game or any intellectual property. 4. OWNERSHIP The Game and all associated materials remain the property of Vitryx Studios or its licensors, including but not limited to: software; source code; artwork; user interface; music; sound effects; animations; characters; logos; icons; game mechanics; databases; trademarks; documentation. Nothing in these Terms transfers ownership of these rights to you. 5. PLAYER CONDUCT You agree not to: cheat; hack; exploit bugs; reverse engineer the Game except where permitted by law; use automation or bots; modify the Game client; interfere with online services; impersonate staff or other players; harass, threaten or abuse others; upload unlawful or offensive content; exploit security vulnerabilities. If you discover a bug, you agree not to intentionally exploit it and to report it where reasonably possible. 6. FAIR PLAY We may investigate behaviour that undermines fair gameplay. Where appropriate, actions may include: warnings; temporary suspensions; leaderboard adjustments; removal of rewards; permanent account termination. These actions are intended to protect the integrity of the Game. 7. VIRTUAL CURRENCY AND VIRTUAL ITEMS The Game may include virtual currencies, cosmetic items, packs, upgrades and other virtual content. These items: are licensed, not sold; have no real-world monetary value; cannot be exchanged for cash through us; may not be transferred outside authorised systems unless expressly permitted. Ownership of virtual items remains with Vitryx Studios. 8. PURCHASES The Game may offer optional purchases. Prices may vary by region and platform. All purchases are subject to the terms and policies of the platform through which they are made. Where applicable, your statutory consumer rights remain unaffected. Refund requests are generally handled through the relevant app store unless otherwise required by law. 9. UPDATES We may release updates that: improve gameplay; add features; balance gameplay; correct bugs; improve security; introduce seasonal content. Some updates may be required to continue using certain online features. 10. AVAILABILITY We aim to provide reliable service but cannot guarantee uninterrupted availability. The Game may occasionally be unavailable due to: maintenance; updates; technical faults; network failures; events beyond our reasonable control. 11. MULTIPLAYER SERVICES Online gameplay depends on internet connectivity. Performance may vary based on: connection quality; latency; server availability; device performance. We may modify or discontinue online services with reasonable notice where practical. 12. USER-GENERATED CONTENT If the Game allows usernames, chat, profiles or other player-created content: You retain ownership of content you create. By submitting such content, you grant Vitryx Studios a non-exclusive, worldwide licence to use, display, reproduce and distribute that content solely for operating, improving and promoting the Game. You must not submit content that infringes the rights of others or violates applicable law. 13. INTELLECTUAL PROPERTY You may not: copy the Game; distribute the Game; commercially exploit the Game; reproduce artwork; create unauthorised derivative works; remove copyright notices. Nothing in these Terms grants permission to use our trademarks without written consent. 14. PRIVACY Our collection and use of personal information is governed by our Privacy Policy. Please read the Privacy Policy carefully before using the Game. 15. SUSPENSION AND TERMINATION We may suspend or terminate access where: these Terms are materially breached; fraudulent activity is detected; security is compromised; continued access could harm the Game or other players. You may stop using the Game at any time. Termination does not affect rights and obligations that have already arisen. 16. DISCLAIMERS The Game is provided on an "as available" basis. While we aim to maintain high standards of quality and reliability, we do not guarantee that the Game will always be free from errors, interruptions or defects. Nothing in these Terms excludes or limits rights that cannot legally be excluded under applicable law. 17. LIMITATION OF LIABILITY To the fullest extent permitted by law, Vitryx Studios shall not be liable for indirect, incidental or consequential losses arising from the use of the Game. Nothing in these Terms limits liability where such limitation would be unlawful, including liability for death or personal injury caused by negligence or liability arising from fraud. 18. CHANGES TO THESE TERMS We may update these Terms from time to time. Where changes are material, we may provide notice within the Game or by other reasonable means. Continued use of the Game after updated Terms become effective constitutes acceptance of the revised Terms. 19. GOVERNING LAW These Terms are governed by the laws of England and Wales unless mandatory laws in your place of residence provide otherwise. ENTIRE AGREEMENT These Terms, together with the Privacy Policy and any additional policies expressly incorporated by reference, constitute the entire agreement between you and Vitryx Studios regarding your use of Battle Fish: Battle Royale. If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect. ACKNOWLEDGEMENT By downloading, installing or using Battle Fish: Battle Royale, you acknowledge that you have read, understood and agreed to these Terms of Service.
